課程介紹

在國際領域中,正義有任何力量嗎?在回答這個最根本的問題之前,也許最好的方法是回到個別具體的國際議題中,審視我們會持什麼樣的道德立場,然後再思考我們真的能夠放棄這些道德立場嗎?我們能夠放棄到什麼程度?
本課程將閱讀和討論國際領域中的道德或正義等議題的主要政治理論著作。我們首先初步熟悉古羅馬和基督教兩個影響西方深遠的傳統,這兩個傳統在討論萬國間的正義/法律(ius gentium or the law of nations)關係時,也同時考慮了人作為人的自然社會性(natural sociability)的豐富關係。奠基近代國際世界思維的馬基維利、格勞休斯和霍布斯等人的思考,都是和這兩個大傳統對話而形成。在這些傳統國際思維中,國與國之間主要的核心道德問題是:戰爭是否合乎正義、正義的戰爭的條件有哪些等等,這些問題構成了傳統國際道德思考的主要部分。我們第一個重心將放在當代對義戰的討論,主要閱讀的文本是Michael Walzer的Just and Unjust Wars: A Moral Argument with Historical Illustrations,以及和他對話的許多作品。從干預這個議題,我們也將延伸討論共同體自決的議題。然後我們把重心轉移到自由主義的普世主義者們(liberal cosmopolitans)身上。康德是第一個打破萬民法傳統,把個人提昇到國際法地位的人,他引起的革命,繼續成為當代許多國際道德議題的主要動能,包括國際經濟正義、移民與邊界、環境正義問題等等,我們也將考慮對普世主義的批評。接下來,我們將花兩週討論後殖民觀點。最後我們將討論全球制度的治理問題。

期望學生能熟悉國際正義的主要文本,並能應用文本於個案中。 
課程要求
課程要求和成績給分規則

(1)15 % 文本閱讀和課堂參與:我每週將會演講60-70分鐘,剩下的30-40分鐘,我將抽點至少6個人回答相關該週文本的問題,每個人都永遠有可能被重複抽到(沒有上限),如果你回答問題時,沒有閱讀該週文本,15分就會拿不到。因此你必需閱讀完文本,再來聽演講。你需要每週出席。缺席將視同未讀文本。

(2)10% 請你們兩個人一組,選一週的主題上台報告,找好人和主題後和助教登記,原則上每週報告兩組,先登記先贏,如果有人先登記了,你們就要換主題。報告時間是6分鐘以內(不能超過)。報告內容是找一個符合當週討論的國際道德議題的當代個案,以當週的文本分析這個個案。你必需在Economists, Foreign Affairs, The Nation, The New Republic, Guardian這些報章期刊中尋找你要的個案。

(3)75% 三次「文本和個案分析」作業。作業內容:作業前半部先分析和批判該文本的論證(請遵循我發的”Guidelines for an Analytical and Critical Reading and Writing”寫作指引),作業後半部選擇一個當代個案進行分析。每次作業3000字以內。

如果您有正當理由要缺席或者遲交書面作業,請於上課或繳交日期前,提前email通知我您的理由和延交日期,並獲得許可。如果沒有提前一天告知,報告晚交一天將扣成績1%,缺席將視同沒有閱讀文本。


關於抄襲

書面作業絕對嚴禁抄襲。抄襲一次,您的成績將低於70分(我會請您來談談);抄襲兩次,低於60分。
請務必遵循以下規則,以免被判定抄襲:
(1)如果您的文章中,有一到兩個長句的文字,和他人或他處一模一樣,您又不是原作者,就會被判定抄襲。
(2) 如果您要引用他人的想法,除了必須註明想法來源,請務必採用以下兩種方式其中一種:(a)如果要一字不漏引用,請用引號把引用的文字全部括起來。(b)如果不是一字不漏引用,您必須完全同義改寫原作者的意思,您的文句和原作者的文句不能相似,如果要使用原作者使用的關鍵詞彙,也必須要使用引號。以上都務必註明引用來源。
